Welcome to JobTrek Pro. These Terms of Service (“Terms” or “Agreement”) govern your access to and use of the JobTrek Pro platform, websites, applications, software, products, and related services (collectively, the “Services”), which are owned and operated by JobTrek Pro LLC (“JobTrek Pro,” “Company,” “we,” “our,” or “us”).

JobTrek Pro is a software platform designed primarily for business users and home service companies to manage scheduling, dispatching, communications, invoicing, payments, customer management, reporting, and related business operations.

By accessing or using the Services, you acknowledge that you have read, understand, and agree to be bound by these Terms.

1. Definitions

For purposes of these Terms:

  • “Services” means the JobTrek Pro platform, website, mobile applications, software, APIs, communications, and related offerings.
  • “Customer” means the business entity subscribing to or using the Services.
  • “User” means any employee, owner, contractor, agent, or representative authorized to access the Services.
  • “Service Data” means information, files, communications, customer information, pricing information, images, documents, and other content submitted through the Services.
  • “Third-Party Providers” means outside companies that provide functionality or integrations including Stripe, Twilio, Google, Apple, Android, mapping providers, hosting providers, cloud providers, and similar vendors.

2. Acceptance of Terms

By accessing or using the Services, you agree to these Terms and all policies incorporated by reference.

If you use the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms, and references to “you” include both you and that entity.

If you do not agree to these Terms, you may not access or use the Services.

3. Business Use

The Services are intended primarily for business and commercial use. Transactions involving the Services are business-to-business transactions and are not intended for personal consumer use.

4. Eligibility

You represent and warrant that:

  • You are at least eighteen (18) years of age.
  • You have the legal authority to enter into binding agreements.
  • You are located in the United States or Canada unless otherwise approved by JobTrek Pro.
  • Your use of the Services complies with all applicable laws and regulations.

We reserve the right to refuse service or terminate accounts that fail to meet these requirements.

5. Account Registration

You may be required to create an account to use certain features of the Services.

You agree to:

  • Provide accurate and current information.
  • Maintain and promptly update account information.
  • Keep login credentials confidential.
  • Restrict access to authorized users.
  • Accept responsibility for all activities occurring under your account.

You must notify us immediately of any unauthorized use or security breach.

6. Administrative Users

Account owners may grant access to employees, contractors, agents, or representatives.

Administrative users may have authority to:

  • Add or remove users.
  • Modify settings.
  • Access customer data.
  • Change payment settings.
  • Configure integrations.
  • Manage subscriptions.

You are solely responsible for the actions of individuals authorized to access your account.

7. Changes to the Services

We continually improve the Services and reserve the right to:

  • Add or remove features.
  • Modify functionality.
  • Discontinue features.
  • Restrict access.
  • Perform maintenance.
  • Improve security.

We may make such changes without prior notice.

8. Changes to these Terms

We may revise these Terms from time to time.

Updated Terms become effective when posted on our website or otherwise communicated to you.

Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.

9. License to Use the Services

Subject to your compliance with these Terms, JobTrek Pro grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services solely for your internal business operations.

The Services are licensed, not sold.

Nothing in these Terms transfers ownership of the Services or any intellectual property rights.

10. Restrictions on Use

You agree not to:

  • Reverse engineer or attempt to derive source code.
  • Copy, distribute, sublicense, or resell the Services.
  • Circumvent security measures.
  • Use the Services unlawfully.
  • Interfere with operation of the Services.
  • Upload malicious code or viruses.
  • Access the Services in an unauthorized manner.
  • Use the Services to provide competing software services.
  • Misrepresent your identity.
  • Use automated tools or bots except as expressly authorized.

11. Customer Responsibilities

You are solely responsible for:

  • Your business operations.
  • Your pricing.
  • Your employees and contractors.
  • Compliance with applicable laws.
  • Taxes and reporting obligations.
  • Customer relationships.
  • Warranties and guarantees you provide.
  • Services you perform for your customers.

JobTrek Pro does not provide legal, tax, accounting, or professional advice.

12. Service Data

You may submit information including:

  • Customer information.
  • Job information.
  • Communications.
  • Images and files.
  • Pricing information.
  • Invoices and estimates.
  • Scheduling information.
  • Employee information.

You retain ownership of your Service Data.

You grant JobTrek Pro and its service providers a non-exclusive, worldwide, royalty-free license to host, process, transmit, reproduce, and use Service Data solely for purposes of providing, securing, maintaining, improving, and supporting the Services.

13. Aggregated and Anonymized Data

JobTrek Pro may create aggregated, anonymized, and statistical data derived from usage of the Services.

Such data shall not identify you or your customers.

JobTrek Pro owns all rights to such aggregated and anonymized data and may use it for analytics, benchmarking, security, and product improvement.

14. Feedback

Any suggestions, ideas, comments, or feedback submitted to JobTrek Pro may be used without restriction and without compensation to you.

You grant JobTrek Pro a perpetual, irrevocable, worldwide, royalty-free right to use such feedback for any lawful purpose.

15. Subscription Plans

Access to certain features requires a paid subscription.

Subscription plans may be offered on monthly, annual, or other billing cycles.

Features, pricing, and limits may vary by plan.

We reserve the right to modify subscription plans and pricing at any time upon notice.

16. Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.

By subscribing, you authorize JobTrek Pro to charge your payment method for recurring subscription fees, applicable taxes, and add-on charges.

17. Billing and Fees

You agree to pay all fees associated with your use of the Services.

All fees are:

  • Due in advance.
  • Non-refundable except as required by law.
  • Exclusive of applicable taxes.

Past due amounts may incur interest, collection costs, or suspension of Services.

Failure to maintain a valid payment method may result in termination or suspension.

18. Cancellation

You may request cancellation by contacting hello@jobtrekpro.com.

Cancellation requests may require verification for security purposes.

Unless otherwise required by law, previously paid fees are non-refundable.

Cancellation does not relieve you of outstanding payment obligations.

19. Communications Consent

By providing your contact information, you authorize JobTrek Pro and its service providers to contact you by telephone, email, SMS messages, automated systems, and in-app notifications.

Such communications may relate to:

  • Account activity.
  • Support.
  • Product updates.
  • Billing.
  • Security notices.
  • Marketing communications where permitted by law.

Message and data rates may apply.

20. SMS Program

By opting into JobTrek Pro’s SMS program, you consent to receive recurring text messages regarding demo scheduling, appointment reminders, customer support, account notifications, product updates, and promotional messages.

Message frequency varies.

You may opt out at any time by replying STOP, STOPALL, END, CANCEL, UNSUBSCRIBE, QUIT, REVOKE, or OPTOUT.

Message and data rates may apply.

Carrier participation is not guaranteed, and mobile carriers are not responsible for delayed or undelivered messages.

21. Payment Processing Services

JobTrek Pro may provide functionality that enables you to accept payments from your customers through the Services (“JobTrek Pro Payments”).

Payment processing services are provided by independent third-party providers, including Stripe, Stripe Connect, Stripe Express, and similar payment processors (collectively, “Payment Processors”).

Your use of JobTrek Pro Payments is subject to these Terms as well as any applicable agreements, policies, and terms imposed by the Payment Processors.

JobTrek Pro is not a bank, money transmitter, payment network, or financial institution and does not hold customer funds.

22. Transaction Fees and Dual-Fee Structure

JobTrek Pro may charge fees in connection with transactions processed through the Services.

Fees may include, without limitation:

  • Subscription fees.
  • Processing fees.
  • Platform fees.
  • Transaction fees.
  • Service fees.
  • Provider platform fees.
  • Chargeback fees.
  • Other fees disclosed through the Services.

When enabled, JobTrek Pro may utilize a dual-fee structure whereby (a) a customer service fee or similar fee may be charged to the customer completing the transaction, and (b) a provider platform fee or other fee may be deducted from the business user’s payout.

You expressly authorize JobTrek Pro and its Payment Processors to calculate, collect, allocate, deduct, and remit such fees in accordance with your account settings and applicable processor capabilities.

JobTrek Pro reserves the right to modify fee structures, percentages, methods of collection, and pricing upon notice.

You are solely responsible for ensuring that fee disclosures and practices comply with applicable federal, state, provincial, and local laws.

JobTrek Pro makes no representations regarding the legality or enforceability of any particular fee structure in any jurisdiction.

23. Card-Not-Present Transactions

Transactions processed through the Services may be treated as card-not-present transactions unless a supported in-person payment method is used.

You acknowledge that card-not-present transactions may carry increased risks of fraud, disputes, and chargebacks.

JobTrek Pro shall not be responsible for losses arising from such risks.

24. Underwriting, Verification, and Risk Reviews

JobTrek Pro and its Payment Processors may conduct reviews of accounts, businesses, transactions, and payment activity for purposes including fraud prevention, identity verification, compliance, risk management, regulatory requirements, and underwriting.

You authorize JobTrek Pro and its Payment Processors to request and obtain information reasonably necessary to complete such reviews.

JobTrek Pro reserves the right to suspend, restrict, or terminate access to payment services pending completion of reviews.

25. Transaction Limits and Restricted Uses

JobTrek Pro and its Payment Processors may establish transaction limits, volume limits, reserve requirements, and prohibited uses.

Certain transactions, industries, or activities may be restricted or prohibited.

JobTrek Pro reserves the right to reject or suspend transactions or accounts that present excessive risk or violate applicable laws, card network rules, or processor requirements.

26. Payouts and Access to Funds

Payouts are initiated in accordance with your account settings and the policies of the applicable Payment Processors.

Payouts may be reduced by:

  • Processing fees.
  • Platform fees.
  • Refunds.
  • Chargebacks.
  • Reserves.
  • Amounts owed to JobTrek Pro.
  • Other applicable deductions.

JobTrek Pro does not guarantee payout timing, availability of funds, continuous payment processing services, or uninterrupted access to payment functionality.

Errors relating to transactions or payouts must be reported within sixty (60) days after the transaction date.

27. Holds, Reserves, and Investigations

JobTrek Pro and its Payment Processors may delay payouts, establish reserves, or temporarily withhold funds if reasonably necessary to investigate suspicious activity, prevent fraud, address excessive chargebacks, satisfy anticipated refunds, comply with legal obligations, mitigate risk exposure, or protect the integrity of the Services.

You grant JobTrek Pro and its Payment Processors a security interest in reserve funds and authorize the deduction of amounts necessary to satisfy obligations arising from your use of JobTrek Pro Payments.

JobTrek Pro shall not be liable for losses resulting from payout holds, reserve requirements, investigations, or actions taken by Payment Processors.

28. Chargebacks, Refunds, and Returned Payments

You are solely responsible for:

  • Chargebacks.
  • Payment disputes.
  • Customer refunds.
  • Returned payments.
  • Fraudulent transactions.
  • Customer complaints.
  • Associated fees and losses.

JobTrek Pro may recover such amounts by:

  • Deducting them from future payouts.
  • Charging your payment method on file.
  • Offsetting amounts owed.
  • Exercising any rights available under these Terms.

A non-refundable chargeback fee may be assessed for each chargeback or dispute.

You remain liable for all obligations arising from transactions processed through the Services.

29. Taxes and Information Reporting

You are solely responsible for determining, collecting, reporting, and remitting all taxes associated with your use of the Services and transactions processed through JobTrek Pro Payments.

Such taxes may include:

  • Sales taxes.
  • Income taxes.
  • Payroll taxes.
  • VAT.
  • GST.
  • Provincial taxes.
  • Local taxes.
  • Other governmental assessments.

JobTrek Pro and its Payment Processors may provide tax reporting information, including Forms 1099-K and other information returns, as required by applicable law.

You acknowledge that JobTrek Pro does not provide tax advice and recommend consulting your own tax professionals regarding your obligations.

30. Third-Party Services and Integrations

The Services may integrate with or rely upon third-party providers and platforms, including but not limited to Stripe, Twilio, Google, Apple, Android, OpenAI, mapping providers, hosting providers, cloud service providers, accounting platforms, calendar providers, email providers, CRM providers, and other third-party vendors.

Third-party services are governed by their own terms, policies, and agreements.

JobTrek Pro does not control and shall not be responsible for the performance, availability, actions, omissions, errors, outages, delays, security, fees, or failures of third-party providers.

Any dispute between you and a third-party provider is solely between you and that provider.

31. Customer Relationships

You are solely responsible for:

  • Your business operations.
  • Services provided to your customers.
  • Pricing decisions.
  • Estimates.
  • Invoices.
  • Refunds.
  • Warranties.
  • Customer support.
  • Employee relationships.
  • Contractor relationships.
  • Compliance with applicable laws.

JobTrek Pro is not a party to agreements between you and your customers and assumes no responsibility for disputes arising therefrom.

32. Acceptable Use

You agree not to use the Services to:

  • Violate applicable laws or regulations.
  • Commit fraud or deceptive practices.
  • Infringe intellectual property rights.
  • Upload malware, viruses, or malicious code.
  • Send unlawful spam or unauthorized communications.
  • Harass, threaten, or abuse others.
  • Interfere with operation of the Services.
  • Circumvent security measures.
  • Access systems without authorization.
  • Use the Services to compete with JobTrek Pro.
  • Resell or sublicense the Services without authorization.
  • Misrepresent your identity.
  • Engage in illegal activities.

JobTrek Pro reserves the right to investigate violations and suspend or terminate accounts in its sole discretion.

33. Intellectual Property

The Services, software, source code, features, graphics, designs, logos, trademarks, content, and related materials are owned by JobTrek Pro LLC and protected by intellectual property laws.

Except for the limited license granted under these Terms, no ownership rights are transferred to you.

You may not copy, modify, distribute, reverse engineer, decompile, or create derivative works from the Services except as expressly permitted by law.

JobTrek Pro and its logos and trademarks may not be used without prior written consent.

34. Ownership of Service Data

You retain ownership of all Service Data submitted through the Services.

Nothing contained in these Terms transfers ownership of Service Data to JobTrek Pro.

You grant JobTrek Pro a non-exclusive, worldwide, royalty-free license to use, store, reproduce, process, transmit, and display Service Data solely for purposes of operating the Services, providing support, maintaining security, preventing fraud, improving the Services, complying with legal obligations, and providing requested functionality.

35. Aggregated and Anonymized Data

JobTrek Pro owns all rights to aggregated, anonymized, and statistical information derived from the use of the Services.

Such information shall not identify you or your customers.

JobTrek Pro may use aggregated data for analytics, product development, security, benchmarking, marketing, business intelligence, and other lawful business purposes.

36. AI Features

The Services may include artificial intelligence features, automated responses, transcription services, summaries, analytics, voice technologies, and similar technologies.

AI-generated outputs may contain inaccuracies and should be independently reviewed.

You acknowledge and agree that:

  • AI outputs are provided for informational purposes only.
  • JobTrek Pro makes no representations regarding accuracy or completeness.
  • You assume all risks associated with reliance upon AI-generated outputs.
  • JobTrek Pro shall not be liable for decisions made based upon AI-generated information.

37. Monitoring and Recordings

You consent to the monitoring, recording, storage, and processing of communications involving JobTrek Pro and certain Service features.

Such communications may include:

  • Phone calls.
  • SMS messages.
  • Emails.
  • Support chats.
  • Voice recordings.
  • AI voice interactions.
  • Other communications.

These recordings may be used for:

  • Customer support.
  • Quality assurance.
  • Security.
  • Training.
  • Compliance.
  • Service improvement.

You are solely responsible for obtaining any legally required consent from your customers, employees, or contractors regarding recordings and communications.

38. Beta and Experimental Features

Certain features may be designated as beta, preview, experimental, early access, or testing features.

Such features are provided on an “AS IS” basis and may be modified, suspended, or discontinued at any time.

JobTrek Pro shall have no liability arising out of or relating to beta or experimental features.

39. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBTREK PRO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, SECURITY, ACCURACY, RELIABILITY, AND AVAILABILITY.

JOBTREK PRO DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, FREE FROM BUGS, FREE FROM DEFECTS, FREE FROM DELAYS, FREE FROM HARMFUL COMPONENTS, OR COMPLETELY SECURE.

40. Service Interruptions and Maintenance

Customer acknowledges that the Services may become temporarily unavailable due to scheduled maintenance, software bugs, coding errors, hardware failures, internet outages, cyberattacks, data center failures, third-party provider failures, system upgrades, and events beyond JobTrek Pro’s reasonable control.

JOBTREK PRO SHALL NOT BE LIABLE FOR ANY LOST PROFITS, LOST REVENUE, LOSS OF BUSINESS, LOSS OF GOODWILL, LOST CUSTOMERS, BUSINESS INTERRUPTION, SPECIAL DAMAGES, INCIDENTAL DAMAGES, OR CONSEQUENTIAL DAMAGES arising from interruptions, delays, defects, bugs, coding errors, or unavailability of the Services.

41. Customer Backup Responsibility

You are solely responsible for maintaining independent backups of customer records, invoices, estimates, job information, communications, pricing information, images, documents, and other Service Data.

JOBTREK PRO SHALL NOT BE LIABLE FOR ANY LOSS, CORRUPTION, DELETION, DESTRUCTION, OR UNAVAILABILITY OF DATA REGARDLESS OF CAUSE.

42. Security

Although JobTrek Pro employs commercially reasonable security measures, no system can be guaranteed to be completely secure.

You acknowledge that cyberattacks, unauthorized access, service interruptions, and data breaches may occur despite reasonable safeguards.

JobTrek Pro does not guarantee absolute security and disclaims liability arising from security incidents beyond its reasonable control.

43. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOBTREK PRO LLC, ITS MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, LICENSORS, SERVICE PROVIDERS, AND SUCCESSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING WITHOUT LIMITATION:

  • LOSS OF PROFITS.
  • LOSS OF REVENUE.
  • LOSS OF BUSINESS.
  • LOSS OF CUSTOMERS.
  • LOSS OF GOODWILL.
  • LOSS OF DATA.
  • BUSINESS INTERRUPTION.
  • COST OF SUBSTITUTE SERVICES.
  • LOST OPPORTUNITIES.
  • OTHER COMMERCIAL DAMAGES OR LOSSES,

ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE SERVICES, EVEN IF JOBTREK PRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF JOBTREK PRO LLC EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100), OR (B) THE TOTAL FEES PAID BY CUSTOMER TO JOBTREK PRO DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THE FOREGOING LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

44. Indemnification

You agree to defend, indemnify, and hold harmless JobTrek Pro LLC and its members, managers, officers, directors, employees, contractors, affiliates, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, settlements, judgments, penalties, fines, costs, expenses, and reasonable attorneys’ fees arising out of or relating to:

  • Your use of the Services.
  • Your violation of these Terms.
  • Your violation of applicable laws or regulations.
  • Claims by your customers.
  • Claims by your employees or contractors.
  • Refund disputes.
  • Chargebacks.
  • Communications sent through the Services.
  • Recording activities.
  • Payment disputes.
  • Your negligence or misconduct.

45. Force Majeure

JobTrek Pro shall not be liable for any delay, interruption, failure, or inability to perform resulting from causes beyond its reasonable control, including but not limited to:

  • Acts of God.
  • Natural disasters.
  • Pandemics.
  • Epidemics.
  • Fire.
  • Flood.
  • War.
  • Terrorism.
  • Labor disputes.
  • Utility failures.
  • Internet outages.
  • Cyberattacks.
  • Government actions.
  • Supply chain disruptions.
  • Failures of third-party providers.
  • Other unforeseen events.

Performance obligations shall be suspended for the duration of such events.

46. Emergency Suspension

JobTrek Pro reserves the right to suspend, restrict, or terminate access to the Services immediately and without prior notice if we determine that such action is necessary to:

  • Protect the security of the Services.
  • Prevent fraud.
  • Protect users or customers.
  • Comply with legal obligations.
  • Respond to cyberattacks.
  • Prevent misuse of the Services.
  • Preserve the integrity or availability of the platform.

JobTrek Pro shall not be liable for damages arising from such actions.

47. Termination

You may terminate your subscription at any time by contacting hello@jobtrekpro.com.

JobTrek Pro may suspend or terminate your account at any time for violation of these Terms, nonpayment, fraud, excessive risk, abuse of the Services, legal compliance reasons, or any other reason in JobTrek Pro’s sole discretion.

Termination shall not relieve you of obligations incurred prior to termination.

Sections relating to intellectual property, limitations of liability, indemnification, arbitration, and similar provisions shall survive termination.

48. Limitation Period

ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM ARISES.

ANY CLAIM NOT BROUGHT WITHIN SUCH PERIOD SHALL BE PERMANENTLY BARRED.

49. Dispute Resolution and Binding Arbitration

Except for claims eligible for small claims court or requests for injunctive relief relating to intellectual property, any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively by binding individual arbitration.

Arbitration shall be administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules.

Arbitration shall take place in the State of Florida.

The arbitrator shall have exclusive authority to resolve disputes regarding the interpretation, applicability, enforceability, or formation of these Terms.

Judgment on any arbitration award may be entered in any court having jurisdiction.

50. Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT ALL DISPUTES SHALL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS.

YOU WAIVE ANY RIGHT TO:

  • PARTICIPATE IN A CLASS ACTION.
  • PARTICIPATE IN A CLASS ARBITRATION.
  • ACT AS A PRIVATE ATTORNEY GENERAL.
  • PARTICIPATE IN REPRESENTATIVE PROCEEDINGS.
  • CONSOLIDATE CLAIMS WITH OTHER PERSONS.

51. Jury Trial Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND JOBTREK PRO KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY.

52. Governing Law

These Terms and any dispute arising out of or relating to the Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

53. Venue

To the extent any dispute is not subject to arbitration, exclusive venue shall lie in the state and federal courts located in Duval County, Florida.

You consent to the personal jurisdiction of such courts.

54. Assignment

JobTrek Pro may assign or transfer these Terms, in whole or in part, without restriction.

You may not assign or transfer your rights or obligations under these Terms without prior written consent from JobTrek Pro.

55. Entire Agreement

These Terms, together with any incorporated policies and agreements, constitute the entire agreement between you and JobTrek Pro regarding the Services and supersede all prior agreements, understandings, or representations.

56. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

57. No Waiver

Failure by JobTrek Pro to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

58. Electronic Communications

You consent to receive notices, disclosures, agreements, and communications electronically.

Electronic communications shall satisfy any legal requirement that such communications be in writing.
