Terms of Service

Welcome to JobTrek Pro, a technology service (the “Service”) operated by JobTrek Pro LLC (“JobTrek Pro,” “we,” “our,” or “us”). The Service is offered through our website(s) and related applications (collectively, the “Website”), and is designed to help service businesses and their teams manage operations (including scheduling, dispatching, invoicing, communications, and payments).

Business-to-business use. You acknowledge and agree that JobTrek Pro is designed primarily for business use, not consumer personal use. When a business subscribes to or uses the Service, it is a business-to-business transaction.

1. Acknowledgement & Acceptance

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms of Service (the “Terms” or “Agreement”). These Terms, together with any policies referenced here (including our Privacy Policy, if/when published), govern your use of the Service.

Who is a “User.” “User” means (i) you as an individual, and (ii) any company or other entity on whose behalf you use the Service. You represent and warrant that you have authority to bind that business/entity to these Terms.

Account admins. If you are the owner or primary account holder, you may grant administrative access to employees, contractors, agents, or representatives. You acknowledge that admins may control your account, including viewing customer information, changing payment settings, adding/removing users, and modifying account configuration.

Changes to these Terms. We may update these Terms at any time by posting a revised version within the Service or on the Website, or by notifying you (at our discretion). Continued use after changes become effective constitutes acceptance. You are responsible for reviewing the Terms periodically.

2. Important Notice About Dispute Resolution & Arbitration

THIS AGREEMENT CONTAINS A DISPUTE RESOLUTION AND ARBITRATION PROVISION THAT AFFECTS YOUR LEGAL RIGHTS. Except for limited exceptions, disputes must be resolved by binding individual arbitration (not class actions), and you waive the right to a jury trial.

3. The JobTrek Pro Service

JobTrek Pro provides web and mobile tools for business operations, which may include scheduling, job management, customer communications, invoicing, reporting, and integrations. Certain features may require additional fees, add-ons, or third-party services.

We may offer access to payment processing, financing-related tools, payroll tools, apps/integrations, or other third-party offerings through providers we do not control (see “Third-Party Offerings”).

4. Eligibility & Use of the Service

The Service is offered to users who are 18 years or older and located in the United States or Canada (unless we explicitly authorize use elsewhere). You may use the Service only if you can form a legally binding contract under applicable law.

You represent and warrant that:

  • information you provide to us (including customer and employee data) is accurate and current
  • you have all rights and permissions needed to provide that data
  • you will comply with all applicable federal, state, local, and provincial laws in connection with your use of the Service.

We reserve the right to suspend or terminate accounts for violation of these Terms.

5. License; Access; Availability

Subject to your compliance with this Agreement, JobTrek Pro grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your internal business operations in accordance with these Terms.

The Service is licensed, not sold. We do not guarantee uninterrupted availability, uptime, or error-free operation, and may restrict access to parts of the Service as needed, including for maintenance, security, or compliance purposes.

6. Service Data You Provide

In using the Service, you may provide data and content including business profile information, customer data, pricing, job details, communications, media, and other information (collectively, “Service Data”).

a. Business Profile; Licenses; Insurance. You may provide information about your business, including licensing and insurance. We do not verify accuracy or completeness.

b. Customer Data. Customer data you enter or import remains yours (or your customer's, as applicable). You grant JobTrek Pro and our service providers the right to use Customer Data to provide and maintain the Service; enable features you use, including communications and payments; support integrations you authorize; and operate, secure, and improve the Service, subject to applicable law and our Privacy Policy.

c. Pricing Data. Pricing data you enter remains yours. We may use anonymized and aggregated pricing and usage data for analytics, benchmarking, product improvement, and business purposes.

d. Feedback. If you submit feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, worldwide right to use such feedback without restriction or compensation.

e. Login Credentials; Account Security. You are responsible for maintaining the confidentiality of your login credentials and all activity under your account. Notify us immediately of unauthorized access. We may disable credentials if we believe you violated these Terms or to protect the Service.

f. Data from Integrations. If you connect third-party accounts (including accounting, CRM, or payment systems), you authorize us to access and share necessary data with those providers to deliver the integration.

g. Geolocation Data. If you enable location-based features, you confirm you have obtained all required notices, consents, and authorizations to share such data.

7. License to Service Data; Aggregated Data

By submitting Service Data, you grant JobTrek Pro a non-exclusive, royalty-free, worldwide license (with the right to sublicense to our providers) to use, copy, transmit, store, modify, display, and distribute Service Data to provide the Service and requested features, to provide customer support, to improve and develop the Service (including analytics, fraud prevention, and security), and for other lawful purposes described at the time of collection or with your consent.

Aggregated & anonymized data. JobTrek Pro owns all rights to anonymized, aggregated, and statistical data derived from Service Data or Service usage, provided such data does not identify you or your customers.

8. Communications; TCPA Consent; Opt-Out

You authorize JobTrek Pro and its agents and service providers to contact you via email, phone, and text using the contact information you provide, including automated technology, for service-related and, where permitted, marketing purposes.

  • Program: JobTrek Pro Service Notifications.
  • Opt-out: Reply STOP to stop service notifications.
  • Help: Reply HELP or contact hello@jobtrekpro.com.
  • Message and data rates may apply.
  • Message frequency: up to several messages per appointment (confirmation, technician arrival, completion, invoice, feedback request).
  • You are responsible for obtaining all required consents for communications you send to customers using the Service and for compliance with applicable laws, including call recording laws.

9. Consent to Monitoring; AI Features; Recordings

You consent that communications with JobTrek Pro, including calls, SMS messages, chats, and in-product messages, may be monitored, recorded, and processed by us and our vendors for quality assurance, support, training, analytics, and service improvement.

If AI-enabled features are provided, including automated responses, transcription, analysis, or AI-generated voice, you consent to such interactions and processing as part of providing the Service.

10. Subscription Fees; Billing; Auto-Renewal

JobTrek Pro may offer subscription plans billed in advance on a monthly, annual, or other recurring basis. By subscribing, you authorize us to charge your payment method for recurring fees, applicable taxes, and add-ons.

  • Auto-renewal: Subscriptions renew automatically unless canceled before the renewal date.
  • No proration: Fees are non-refundable and not prorated except where required by law or expressly stated.
  • Price changes: We may change pricing with notice; continued use constitutes acceptance.
  • Late payments: Past-due balances may incur interest or late fees up to the maximum permitted by law.

Cancellations: To request cancellation, email hello@jobtrekpro.com. We may verify requests for security purposes.

11. Payment Processing Terms (JobTrek Pro Payments)

JobTrek Pro may allow you to accept payments from your customers through the Service (“JobTrek Pro Payments”). Payment processing is provided through third-party payment processors, including Stripe and Stripe Connect/Express or similar services (“Third-Party Payment Processors”). Your use of JobTrek Pro Payments is subject to the applicable processor terms in addition to this Agreement.

11.1 Dual-Fee Structure. When enabled, JobTrek Pro may apply fees to transactions processed through the Service, including a Customer Service Fee (paid by the customer) and a Provider Platform Fee (currently 3%) deducted from your payout for use of the platform and payment tools. Fees may be collected within the same transaction and allocated through processor capabilities. You authorize JobTrek Pro and its processors to calculate, collect, deduct, and remit these fees as configured in your account. You are responsible for ensuring fee presentation and disclosures comply with applicable laws.

11.2 Card-Not-Present Transactions. Transactions may be treated as card-not-present unless a supported in-person method is used.

11.3 Underwriting; Reviews; Verification. We and our processors may review accounts and transactions for risk, fraud, and compliance and may restrict features or payouts during review.

11.4 Transaction Limits; Restricted Uses. We may impose limits or prohibit certain transaction types in accordance with processor rules.

11.5 Fees; Changes. Processing and transaction-related fees may change with notice.

11.6 Payouts; Access to Funds. Payouts are initiated according to your account settings, net of fees, chargebacks, reserves, refunds, or amounts owed. Errors must be reported within 60 days.

11.7 Holds; Reserves; Investigations. We may delay payouts or establish reserves to cover disputes, refunds, or risk exposure. You grant us a security interest in reserve funds.

11.8 Chargebacks; Chargeback Fee. You are responsible for chargebacks and related costs. A non-refundable $25 chargeback fee applies per chargeback.

11.9 Refunds. You are responsible for refunds and compliance with card network rules.

11.10 Taxes; 1099 / Reporting. You are responsible for all taxes. We may report payment totals as required by law.

12. Third-Party Offerings and Integrations

Third-party services are governed by their own terms. JobTrek Pro is not responsible for third-party services or disputes related to them.

13. Your Relationship With Your Customers

You are solely responsible for your services, customer relationships, pricing, refunds, warranties, licensing, and compliance. JobTrek Pro is not a party to your customer contracts.

14. Acceptable Use

You may not use the Service to violate laws, infringe rights, distribute malware, send unlawful spam, store sensitive payment credentials improperly, post prohibited content, or operate a service bureau without authorization.

15. Intellectual Property

JobTrek Pro owns all rights in the Service and related technology. You retain ownership of content you upload, subject to the licenses granted herein.

16. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND.

17. Limitation of Liability

To the maximum extent permitted by law, JobTrek Pro's total liability shall not exceed the fees you paid to JobTrek Pro in the six (6) months preceding the event giving rise to the claim.

18. Indemnification

You agree to indemnify and hold harmless JobTrek Pro from claims arising out of your use of the Service, customer disputes, or violations of law.

19. Termination

We may suspend or terminate accounts at any time. Certain provisions survive termination.

20. Governing Law; Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Venue for any court proceedings not subject to arbitration shall be exclusively in Duval County, Florida.

21. Dispute Resolution; Mandatory Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) in the State of Florida. Class actions and jury trials are waived. You may opt out of arbitration by providing written notice within 30 days of first accepting these Terms.

22. Miscellaneous

If any provision is unenforceable, the remainder remains in effect. We may assign this Agreement. Notices may be sent electronically.
