Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the JobTrek Pro platform, websites, applications, software, and related services (collectively, the "Services").

By accessing or using the Services, you agree to comply with this Acceptable Use Policy in addition to our Terms of Service and Privacy Policy.

Failure to comply with this AUP may result in suspension, restriction, or termination of your account without refund and may subject you to legal action where appropriate.

1. General Principles

JobTrek Pro is designed to help businesses manage scheduling, dispatching, communications, invoicing, payments, customer relationships, and other operational functions.

Users must use the Services responsibly, lawfully, and in good faith.

You are solely responsible for your use of the Services and for ensuring that your employees, contractors, agents, and authorized users comply with this AUP.

2. Prohibited Activities

You may not use the Services for any unlawful, harmful, fraudulent, abusive, or unauthorized purpose.

Without limitation, you may not use the Services to engage in any of the following:

A. Illegal or Fraudulent Activity

You may not:

  • Violate any applicable law or regulation;
  • Promote or facilitate fraud, scams, or deceptive practices;
  • Offer or solicit unlawful products or services;
  • Engage in money laundering activities;
  • Process transactions on behalf of undisclosed third parties;
  • Misrepresent your business or identity;
  • Submit false or misleading information.

B. Abuse of Communications Tools

You may not:

  • Send messages without required consent;
  • Violate the TCPA, CAN-SPAM Act, CASL, or similar laws;
  • Send spam or unsolicited marketing communications;
  • Operate pyramid schemes or deceptive campaigns;
  • Harass, threaten, intimidate, or abuse others;
  • Send obscene, hateful, defamatory, discriminatory, or unlawful content;
  • Use purchased, scraped, or unauthorized contact lists;
  • Ignore unsubscribe or STOP requests.

You are solely responsible for maintaining records of customer consent and complying with applicable communication laws.

C. Payment and Financial Misconduct

You may not:

  • Process transactions prohibited by Stripe or applicable card network rules;
  • Engage in money laundering or fraudulent payment activity;
  • Use unauthorized bank accounts;
  • Misrepresent transactions;
  • Attempt to circumvent fees or restrictions;
  • Process payments for third parties without authorization;
  • Engage in excessive chargeback activity.

JobTrek Pro reserves the right to restrict or terminate payment functionality where excessive risk is present.

D. Security Violations

You may not:

  • Attempt unauthorized access to accounts, systems, or data;
  • Circumvent security measures;
  • Introduce malware, ransomware, viruses, or malicious code;
  • Interfere with operation of the Services;
  • Conduct denial-of-service attacks;
  • Attempt to probe or exploit vulnerabilities;
  • Use automated systems or bots without authorization.

E. Intellectual Property Violations

You may not:

  • Infringe copyrights, trademarks, trade secrets, or patents;
  • Copy, reverse engineer, or exploit the Services without authorization;
  • Use JobTrek Pro branding without written permission;
  • Misappropriate proprietary information.

F. Misrepresentation

You may not:

  • Impersonate another person or company;
  • Provide false credentials or inaccurate information;
  • Misrepresent licensing, insurance, or business qualifications;
  • Mislead customers regarding your identity or services.

G. Harmful Content

You may not use the Services to distribute or promote:

  • Pornographic content;
  • Child exploitation material;
  • Terrorist content;
  • Violent or hateful material;
  • Illegal drugs;
  • Fraudulent schemes;
  • Malware or malicious software;
  • Content prohibited by law.

3. Communications Compliance

If you send SMS messages, emails, or other communications through the Services, you must:

  • Obtain required consent before sending messages;
  • Maintain accurate records of consent;
  • Honor opt-out and unsubscribe requests;
  • Include required disclosures;
  • Comply with TCPA, CAN-SPAM, CASL, and applicable laws;
  • Avoid excessive complaint rates.

JobTrek Pro reserves the right to restrict or suspend messaging capabilities if your account presents elevated compliance risks.

4. Monitoring and Enforcement

JobTrek Pro may monitor platform activity to maintain security, compliance, and integrity.

We reserve the right to:

  • Investigate suspected violations;
  • Restrict access to features;
  • Suspend accounts;
  • Terminate accounts;
  • Remove content;
  • Restrict messaging capabilities;
  • Cooperate with regulators or law enforcement.

JobTrek Pro is under no obligation to provide advance notice before taking protective action.

5. Reporting Violations

Suspected violations of this Acceptable Use Policy may be reported to:

JobTrek Pro reserves the right to investigate all reports and take action deemed appropriate.

6. Changes to this Acceptable Use Policy

JobTrek Pro may modify this Acceptable Use Policy from time to time.

Changes become effective when posted with an updated "Last Updated" date.

Continued use of the Services following such changes constitutes acceptance of the revised Acceptable Use Policy.

7. Relationship to Other Agreements

This Acceptable Use Policy is incorporated into and forms part of the JobTrek Pro Terms of Service.

In the event of a conflict between this Acceptable Use Policy and the Terms of Service, the Terms of Service shall control.
